PPO recommends model documents co-authored by DZP experts

The Public Procurement Office has published and recommended on its website model public procurement documents that DZP lawyers helped to draw up.

These documents are:

• an analysis of best practices for the performance of IT contracts with special focus on the specifics of OPIE axis 7 IT projects
  This document sets out best practices and recommendations for both the conduct of public procurement procedures in the IT sector and the performance of contracts concluded. The document shows the specific needs of individual IT sector market participants – both contracting authorities and contractors – and discusses risk balancing mechanisms and protection of these entities' interests. The authors' aim was to provide practical assistance to entities conducting public procurement procedures for IT systems with structuring transparent contractual provisions. 
  This publication was co-authored by our IP&TMT Practice experts: Aleksandra Auleytner, Partner and Head of Practice, Wojciech Dziomdziora, Counsel, Rafał Kłoczko, Associate, and Jakub Kubalski, Associate.
• technical dialogue rules, commentary on applying technical dialogues and model technical dialogue notice
  The authors' intention was to show the technical dialogue structure in the context of the many benefits technical dialogue brings. They showed how technical dialogue clearly helps to simplify and increase the effectiveness of the public contract award process, thereby responding to the challenges faced on a constantly changing market. In the above publications the authors therefore recommend wider use of this concept.
  These publications were authored by DZP's Infrastructure & Energy Practice experts: Katarzyna Kuźma, Partner and Head of the Public Procurement Team, Wojciech Hartung, Counsel, Michał Bagłaj, Senior Associate, and Jakub Krysa, Associate.

The documents were drawn up on the basis of DZP's practice and experience and during consultations with representatives from the Ministry of Finance, the Ministry of Administration and Digitisation, the Social Security Institute, the Healthcare IT Systems Centre, the Polish Chamber of Information Technology and Telecommunications, the Free and Open Source Software Foundation and the Public Procurement Office. As a result, they should fully meet the needs of the various participants on the public procurement market.  

The Public Procurement Office has recommended the use of the above documents to all contracting authorities regardless of the source from which a given procedure is financed, including EU subsidies.
